Terms of Service & User Agreement

1. Explicit Medical Disclaimer (Not Medical Advice)

DNA Labs India operates strictly as an independent diagnostic and genetic testing laboratory. We do not provide medical diagnoses, treatment plans, or emergency medical services.

• The test reports provided by DNA Labs India are purely investigational and must be interpreted by a registered medical practitioner (RMP) or a qualified physician.
• No doctor-patient relationship is established between you and DNA Labs India, its pathologists, or its staff by virtue of utilizing our diagnostic services.
• You agree not to delay seeking professional medical advice or disregard medical instructions based on the information provided in our reports.

2. Strict Compliance with PC&PNDT Act, 1994

DNA Labs India strictly enforces and complies with the Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994. We absolutely do not conduct, facilitate, or tolerate any form of prenatal sex determination. Any attempt by a patient, agent, or referring doctor to request sex determination will result in immediate cancellation of services without a refund, and the incident will be reported to the appropriate law enforcement authorities.

3. Biological Sampling & Chain of Custody

For specific tests, especially those related to legal relationship testing (e.g., Legal Paternity, Immigration DNA), rigorous Chain of Custody (CoC) protocols apply.

• Identification: Patients must provide valid, government-issued photo identification (Aadhaar, Passport) at the time of sample collection.
• Right to Reject: We reserve the right to reject any sample that is compromised, mislabeled, or collected without verified identification.
• Turnaround Times (TAT): All stated TATs are approximate. DNA Labs India accepts no legal liability for delays caused by biological re-testing requirements, laboratory equipment contingencies, or Force Majeure events.

4. Payments, Billing & Chargebacks

All services must be paid for in full prior to sample processing. By providing payment information, you represent that you are authorized to use the payment method.

• Unauthorized Chargebacks: You agree not to initiate unlawful chargebacks or payment disputes with your bank after a service has been rendered or a sample has been accessioned. Any such attempt will be treated as financial fraud, and we reserve the right to initiate legal recovery proceedings.
• Refunds: All refunds are strictly governed by our Refund & Cancellation Policy, which is incorporated into these terms by reference.

5. Indemnification

You agree to indemnify, defend, and hold harmless DNA Labs India, its directors, officers, pathologists, employees, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your breach of these Terms of Service.
• Your failure to provide accurate medical history or valid identification.
• Your misinterpretation or misuse of the diagnostic reports provided.

7. Modifications to Terms

DNA Labs India reserves the right to modify, alter, or update these Terms of Service at any time without prior individual notice. Your continued use of our services following the posting of changes constitutes your acceptance of those changes.
